Important Medical Disclaimer
DriverWell is a wellbeing support tool, not a medical service. It does not provide medical diagnoses, clinical treatment, or emergency response. If you are experiencing a medical or mental health emergency, please call 999 or contact the Samaritans on 116 123 immediately.
1. Agreement to Terms
By accessing or using DriverWell (driverwell.co.uk), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the platform.
DriverWell is operated by Peter McKenna. These terms are governed by the laws of England and Wales.
2. Service Description
DriverWell is a free mental health and wellbeing platform designed for professional drivers. The platform provides:
- Mood tracking and check-in tools
- Stress relief and mindfulness exercises
- Fatigue management tools
- Anonymous peer support forum
- AI-powered wellbeing chat (RoadMate)
- Emergency support resources and helpline information
- Health tracking (blood glucose, wellness logs, hydration)
- Educational content and blog articles
- Employer/operator toolkit for fleet wellbeing management
Free to use: DriverWell is provided free of charge. We are funded through voluntary donations and sponsorships, not through selling user data.
3. Medical & Clinical Disclaimer
DriverWell is not a medical device, clinical service, or substitute for professional healthcare.
The content and tools provided on DriverWell are for general wellbeing and informational purposes only. They are not intended to:
- Diagnose any medical or mental health condition
- Replace advice from a qualified healthcare professional
- Provide clinical treatment or therapy
- Serve as an emergency response service
The mood tracking, fatigue logging, blood glucose tracking, and wellness scoring features are self-reporting tools designed to help you monitor your own patterns. They do not constitute medical assessments.
RoadMate AI is an AI chatbot that provides general wellbeing support and signposting. It is not a therapist, counsellor, or medical professional. If RoadMate detects signs of crisis, it will direct you to emergency resources.
Always seek the advice of your GP or a qualified mental health professional for any medical or mental health concerns.
4. User Accounts
Some features of DriverWell require you to create an account via our authentication provider. By creating an account, you agree that:
- You are at least 18 years old
- You will provide accurate information
- You are responsible for maintaining the security of your account
- You will not share your account with others
- You will notify us of any unauthorised use of your account
You can delete your account at any time through your account settings. This will permanently remove all your personal data from our systems.
5. Acceptable Use & Community Guidelines
When using DriverWell's community features (peer support forum, display names), you agree to:
- Treat other users with respect and empathy
- Not post content that is abusive, threatening, discriminatory, or illegal
- Not share personal identifying information about other users
- Not use the platform to promote products, services, or political campaigns
- Not attempt to access other users' accounts or data
- Not use automated tools to scrape or collect data from the platform
We reserve the right to remove content and suspend accounts that violate these guidelines.
6. Prohibited Uses
You must not use DriverWell to:
- Violate any applicable law or regulation
- Impersonate any person or entity
- Transmit viruses, malware, or other harmful code
- Attempt to gain unauthorised access to our systems
- Interfere with or disrupt the platform's operation
- Collect user data without authorisation
- Use the AI chat to generate harmful, illegal, or misleading content
7. Intellectual Property
The DriverWell name, logo, and branding are the property of Peter McKenna. The content, design, and code of the platform are protected by copyright.
Content you create on the platform (mood entries, forum posts, chat conversations) remains your data. You grant us a limited licence to store and display this content as necessary to provide the service.
Educational content, blog articles, and resource information on DriverWell are provided for personal use. You may share links to our content but may not reproduce it commercially without permission.
8. Employer & Operator Features
Employers and operators who use DriverWell's fleet management features agree that:
- They will use the tools in accordance with UK employment law and data protection regulations
- Welfare checks and risk assessments are management tools, not clinical assessments
- They will not use driver data to discriminate against or penalise employees for mental health disclosures
- They are responsible for their own duty of care obligations under the Health and Safety at Work Act 1974
- DriverWell's toolbox talks and policy templates are guidance documents, not legal advice
9. Limitation of Liability
DriverWell is provided "as is" without any warranties, express or implied. While we strive to ensure the platform is accurate, reliable, and available, we cannot guarantee:
- Uninterrupted or error-free service
- The accuracy or completeness of any content
- That the platform will meet your specific requirements
- The availability of third-party helplines or resources we link to
To the fullest extent permitted by law, DriverWell and its operator shall not be liable for any indirect, incidental, or consequential damages arising from your use of the platform.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
10. Changes to These Terms
We may update these Terms of Use from time to time. We will notify users of significant changes through the platform. Your continued use of DriverWell after changes are posted constitutes acceptance of the updated terms.
11. Governing Law
These Terms of Use are governed by the laws of England and Wales. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
